Partner Andrew Dunlap spoke at a CLE program titled Recent Developments in Distressed Debt, Restructurings, and Workouts 2024 at the Practising Law Institute (PLI). The program covered current issues related to structuring, drafting and enforcing the rights of creditors and parties to loans, various executory contracts and intercreditor agreements, principally in out-of-court restructurings and exchange offers.
Andrew was a on panel titled “Liability Management Strategies: Unpacking the Playbook” where he and his fellow panelists discussed why priming financings are more prevalent in today’s market, documentation issues, potential challenges and litigation risks to borrowers and creditors, and the impact and takeaways from recent cases.
He was joined on the panel by Adam Shpeen, Davis Polk & Wardwell LLP; Conray Tseng, Latham & Watkins LLP; and Patrick Walling, Proskauer Rose LLP.
