Victory in New Mexico Court Protects Voter Rights for Thousands of Citizens

Selendy Gay, in partnership with the Campaign Legal Center (“CLC”), obtained a court order ensuring full implementation of the New Mexico Voting Rights Act ("NMRA"). This law improves ballot access and restores the voting rights of over 11,000 citizens who are on probation and parole by establishing that the right to vote is restored upon release from prison.  

Leading up to the 2024 election, various New Mexico state agencies failed to implement the law, risking the disenfranchisement of many voters, predominantly voters of color. After Selendy Gay filed a lawsuit and a preliminary injunction, the state agencies agreed to ensure that wrongfully rejected voter registration applications would be processed and that NMRA would be proactively and accurately communicated to voters and election officials.

This case builds upon the firm’s recent work with CLC in support of voting rights in Arizona, where Selendy Gay’s amicus brief helped defend the right to vote for nearly 100,000 Arizonans.
